1. Introduction

1.1 These terms of service set out the terms between you the user and The Active Indoor Leisure Association Ltd (“Active Indoor Leisure Association,” “TAILA,” “https://activeindoorleisure.com,” “we,” “us,” or “our”).

1.2 Your use of this website and any service of the Active Indoor Leisure Association Ltd (collectively, the “Services”) constitutes acceptance of these terms of service in full.

1.3 You should not use this website if you do not accept these terms of service in full.

1.4 If you are accepting these terms of service as a representative of, or on behalf of, another legal entity, including a business or government entity, you represent that you have full legal authority to bind such entity to these terms of service.

2. Customer Information

2.1 You should always check that the contact information you provide is correct before creating an account.

2.2 You are responsible for maintaining your own username and password, where required to access your account. You should ensure that you store your username and password securely and that the details required to access your account are not provided to another party.

2.3 You are responsible for your account and actions taken within it. If you are aware or suspect that your account username and password or other details have become known to a third party, you should inform us immediately.

2.4 Our website is only intended for use by adults.

2.5 We reserve the right to restrict or remove your access to this website where you breach these terms of service. Such restriction or removal will take place without recourse or explanation to you where we solely deem it appropriate or necessary.

4. Customer Complaints

We endeavour to respond to all complaints or queries within five working days.

5. Events outside our control

We shall not be liable for delay or failure to perform any obligation under these terms of service if the delay or failure is caused by any circumstances beyond our reasonable control, including, but not limited to, acts of god, war, civil disorder or industrial dispute.

6. Licence

6.1 We grant you a personal, non-transferable, non-exclusive, revocable, limited licence to access the content, information and services solely as permitted by these terms of service, for personal use only.

6.2 This licence allows you to download and cache (using your browser) individual pages from our website.

6.3 Except as permitted through the Services or as otherwise permitted by us in writing, your license does not include the right to:

  • license, sell, transfer, assign, distribute, host, or otherwise commercially exploit the Services or Content;
  • modify, prepare derivative works of, disassemble, decompile, or reverse engineer any part of the Services or Content; or

6.4 This licence does not allow you to download and modify individual pages or substantial parts of our website nor to make our website available via an intranet, where our website or a substantial part of it is hosted locally on the intranet in question.

6.7 Third parties are not allowed to “deep link” to pages within our website, without our express prior written permission. 7.1 All website content generated by us, including but not limited to, databases, graphics, buttons, icons, logos, layouts and look & feel are our copyright, unless expressly acknowledged as otherwise.

7.2 The data mining, extraction or utilisation of product information from our website is not permitted without our express prior written permission.

8.1 The Services may contain information, text, links, graphics, photos, videos, or other materials (“Content”), including Content created or submitted to the Services by you or through your Account (“Your Content”). We take no responsibility for and we do not expressly or implicitly endorse, support, or guarantee the completeness, truthfulness, accuracy, or reliability of any of Your Content.

8.2 By submitting Your Content to the Services, you represent and warrant that you have all rights, power, and authority necessary to grant the rights to Your Content contained within these Terms. Because you alone are responsible for Your Content, you may expose yourself to liability if you post or share Content without all necessary rights.

8.4 You retain any ownership rights you have in Your Content, but you grant The Active Indoor Leisure Association Ltd the following license to use that Content:

8.5 Any ideas, suggestions, and feedback about The Active Indoor Leisure Association Ltd or our Services that you provide to us are entirely voluntary, and you agree that we may use such ideas, suggestions, and feedback without compensation or obligation to you.

8.6 Although we have no obligation to screen, edit, or monitor Your Content, we may, in our sole discretion, delete or remove Your Content at any time and for any reason, including for violating these Terms, violating our  Content Policy (See 22. Content Policy), or if you otherwise create or are likely to create liability for us.

9. Third Party Content, Advertisements & Promotions

9.1 The Services may contain links to third-party websites, products, or services, which may be posted by advertisers, our affiliates, our partners, or other users (“Third-Party Content”). Third-Party Content is not under our control, and we are not responsible for any third party’s websites, products, or services. Your use of Third-Party Content is at your own risk and you should make any investigation you feel necessary before proceeding with any transaction in connection with such Third-Party Content.

10.6 These terms and conditions do not exclude or limit liability where this conflicts with the applicable law for this jurisdiction.

11. Forbidden Actions

11.1 When using or accessing our website, you must comply with these terms of service and all applicable laws, rules, and regulations. Please review section 22. Content Policy, which are part of these Terms and contain the Active Indoor Leisure Association’s rules about prohibited content and conduct. In addition to what is prohibited in the Content Policy (See 22. Content Policy), you may not do any of the following:

  • Use the Services in any manner that could interfere with, disable, disrupt, overburden, or otherwise impair the Services.
  • Gain access to (or attempt to gain access to) another user’s Account or any non-public portions of the Services, including the computer systems or networks connected to or used together with the Services.

  • Access, search, or collect data from the Services by any means (automated or otherwise) except as permitted in these Terms or in a separate agreement with The Active Indoor Leisure Association Ltd.
  • Use the Services in any manner that we reasonably believe to be an abuse of or fraud on The Active Indoor Leisure Association Ltd’s or any payment system.

12. Indemnity

By your use of our website you hereby indemnify us and undertake to keep us indemnified at all times now and in the future against all possible claims relating to any breach of these terms and conditions by you. Such indemnities to include, (but not be limited to) all costs legal and otherwise, all other expenses, damages or settlements arising from your breach of these terms and conditions.

We reserve the right to vary these terms & conditions at any time, without giving notice to you. Such varied terms and conditions shall automatically apply to the use of our website from the date of publication on our website.

14. Assignment

We reserve the right to assign our rights and also our obligations under these terms and conditions, without giving notice to you. This right of assignment shall only apply to us and shall not apply to you in any way.

15. Severability

The paragraphs, sub-paragraphs and clauses of these terms of service shall be read and construed independently of each other. Should any part of these terms of service or paragraphs, sub-paragraphs or clauses be found invalid it shall not affect the remaining paragraphs, sub-paragraphs and clauses.

Failure by us to enforce any accrued rights under these terms of service is not to be taken as or deemed to be a waiver of those rights by us unless we acknowledge the waiver in writing.

These terms of service are between you and us. They do not apply to, or benefit any third party and are not reliant on any third party.

18. Entire Terms of Service

These terms of service set out the entire agreement and understanding between you and us.

19. The Consumer Rights Act 2015 – UK

These terms of service are specifically written in accordance with the Consumer Rights Act 2015. Should these terms of service conflict with the Act, the Consumer Rights Act 2015 shall prevail and apply.

20. Your Statutory Rights

Where acting as a consumer your statutory rights are unaffected.

21. Jurisdiction

These terms of service shall be interpreted, construed and enforced in accordance with English law and shall be subject to the exclusive jurisdiction of the English Courts.

22. Content Policy

The Active Indoor Leisure Association is a community of people, humans, just like you.

Through our community, you can post, comment, vote, discuss, learn, debate, support, and connect with people who share your interests and passions, and we encourage you to find—or even create—a place of mutual benefit here on the Active Indoor Leisure Association..

Not every community may be for you (and you may find some un-relatable or even offensive). Our community should create a sense of belonging and unity for our members, and not diminish it for others. Likewise, everyone in our community should have an expectation of privacy and safety, so please respect the privacy and safety of others.

Every community on The Active Indoor Leisure Association is defined by its users. Some of these users help manage the community as moderators. The culture of each community is shaped explicitly, by the community rules enforced by moderators, and implicitly, in the discussions of its community members. Please abide by the rules of communities in which you participate and do not interfere with those in which you are not a member.

Below the rules governing each community are the platform-wide rules that apply to everyone on The Active Indoor Leisure Association. These rules are enforced by us.

The Active Indoor Leisure Association and its communities are only what we make of them together, and can only exist if we operate by a shared set of rules. We ask that you abide by not just the letter of these rules, but the spirit as well.

22.1 Content Policy Rules

Rule 1

Think of the human behind the profile. The Active Indoor Leisure Association is a place for creating community and belonging, not for attacking marginalised or vulnerable groups of people. Everyone has a right to be free of harassment, bullying, and threats of violence. Communities and users that incite violence or that promote hate based on identity or vulnerability will be banned and wherever possible, reported to the relevant authorities.

Rule 2

Abide by community rules. Post authentic content into communities where you have a personal interest, and do not cheat or engage in content manipulation (including spamming, vote manipulation, ban evasion, or subscriber fraud) or otherwise interfere with or disrupt communities.

Rule 3

Respect the privacy of others. Instigating harassment, for example by revealing someone’s personal or confidential information, is not allowed. Never post or threaten to post intimate or sexually-explicit media of someone.

Rule 4

Do not post or encourage the posting of sexual or suggestive content involving minors.

Rule 5

You should use your real name on The Active Indoor Leisure Association, but don’t have to (you can use a nickname). Don’t impersonate an individual or an entity in a misleading or deceptive manner.

Rule 6

Ensure people have predictable experiences on the Active Indoor Leisure Association by properly labelling content and communities.

Rule 7

Keep it legal, and avoid posting illegal content or soliciting or facilitating illegal or prohibited transactions.

Rule 8

Don’t break the site or do anything that interferes with normal use of The Active Indoor Leisure Association.

Rule 9

This is a community used for professional purposes. Do not post content that is graphic, sexually explicit or offensive.

Rule 10

No solicitation or advertisements (except when facilitated by the Service). The effectiveness of this service is underpinned by the peer to peer sharing of experience and best practice. Solicitation or advertisement, will erode the effectiveness of this site and the trust of the users. Please contact The Active Indoor Leisure Association team if you wish to take offer the opportunity to place advertisements in a considered manner.

22.2 Content Policy Enforcement

We have a variety of ways of enforcing our rules, including, but not limited to

  • Asking you nicely to knock it off
  • Asking you less nicely
  • Temporary or permanent suspension of accounts
  • Removal of privileges from, or adding restrictions to, accounts
  • Removal of content
  • Removing groups
